ASUTAY PRODUCT WARRANTY POLICY

1) Electric and Diesel Scissor Lifts are subject to the terms and conditions herein, subject to the normal use of each new machine manufactured and sold by Asutay Mühendislik ("Asutay"), its authorized sales and service centers ("ASSM") and the original purchaser ("Buyer"). warrants it to be free from defects in materials and workmanship for a period of twenty-four (24) months from the date of manufacture, under its conditions. The warranty will be valid subject to the operation of the machine in accordance with the rules, precautions, instructions and maintenance requirements specified in the relevant Operation and Maintenance manuals.

Asutay's sole liability to the Buyer and ASSM is limited to the repair or replacement of any product or part that Asutay, at its sole discretion and option, determines to be defective in material or workmanship. Replaced products or parts may be new or factory approved refurbished parts at Asutay's sole discretion. All repairs or replacements must be made by trained and qualified technicians according to ISO standards, using only original parts supplied by Asutay. Any part repaired or replaced under warranty is only warranted for the warranty period of the repaired or replaced part.

It also warrants that the structural components of every new machine it manufactures are free from defects in materials and workmanship for a period of thirty-six (36) months, especially for the main frame, trusses and basket construction. Any such part or parts found to be defective upon inspection by Asutay authorized personnel will be replaced or repaired by Asutay authorized personnel or ASSM.

*** The structural warranty specifically excludes adverse effects on the machine structure resulting from equipment damage, misuse or misuse due to user errors.

Asutay Product Warranty does not apply to normal wear and tear with use. It also does not apply to negligence by the operator and vehicle-related authorities; use of vehicles beyond their rated capacity or other misuse or neglect; improper installation, storage or operation; Failure to take action in accordance with the Vehicle's User's Manual or Maintenance Manual or Spare Parts Manual, services or repairs other than parts other than original parts (unless approved in writing by Asutay) by qualified technicians trained in accordance with ISO standards or provided by Asutay; electrical faults due to loose wiring, crushing or corrosion; Changes to original designs and/or components are not covered by the warranty.

Asutay disclaims (and has not permitted any other person or entity to assume on behalf of Asutay) any other warranty or liability in connection with any product covered by this warranty. Under no circumstances can Asutay's liability exceed the cost of repairing or replacing a defective product or part.

Our company is also responsible for the contrary situation in the supply chain related to the products under warranty (removal of the products from the manufacturing programs, delay in the production, etc.) or the natural disaster, war, terrorism, pandemic, government or state embargo application or the transportation of the products supplied from abroad. does not accept any responsibility that may arise due to the failure to perform its services or delays in domestic supplies due to reasons such as national strike/lockout, accidents, flood, fire or other natural disasters.

Asutay shall not be subject to any other liability including, without limitation, personal injury, death, rupture and/or property damage (breach of contract, breach of warranty). Without limiting the generality of the foregoing, Asutay in particular, damages due to property damage, penalties, special or punitive damages, lost profits or revenue, freight cost to transport the Machine to a repair facility, downtime, lost time for workers, lost orders, lost rental income. for incidental or consequential costs, losses or damages, cost of capital, cost of replacement products or services, increased overheads or any other economic loss of any kind, or of any Buyer's customers or any third party Asutay is not responsible for and refuses any final, incidental, indirect or contingent damages for such damages, costs or claims.

2) Machines may be kept in stock by an authorized Distributor / ASSM for a maximum of six (6) months from the date of shipment from Asutay before the warranty period starts automatically on each machine. The warranty period starts as soon as the Distributor / ASSM issues or delivers the Sales Document to the 3rd Party (Buyer), whichever comes first.

3) It is the Distributor's / ASSM's responsibility to complete and return a Pre-Delivery Check Registration, Warranty Registration Form to Asutay before the machine is rented / borrowed / demonstrated or delivered to the end user. In the case of direct sales to end customers, the same responsibility lies with the buyer.

4) The distributor, ASSM or the buyer will not be entitled to take advantage of the warranty and Asutay will have no obligation here, unless the "Pre-Delivery Check Form" and the "Warranty Registration Form" are duly filled and returned to Asutay Sales and Marketing department.

5) Any part or parts found to be defective within the warranty period specified in the inspection by Asutay Technical Department will be replaced or repaired free of charge through the Distributor/ASSM at Asutay's discretion. All parts replaced under warranty must be genuine Asutay parts purchased through an authorized Asutay Distributor/ASSM, unless expressly agreed otherwise in writing and by Asutay's Technical Department.

6) All parts claimed under warranty must be kept in suitable conditions for return and inspection if requested for a period of 60 days from the date the claim is submitted. Parts must be individually labeled or marked with the vehicle serial number and part number. All returned parts must be in the same condition as when they were received from the factory, without any changes to the original design. If parts are to be repaired, prior authorization will be required from the Asutay Technical Department before the repair is complete. All parts replaced under warranty and not returned to Asutay must be destroyed. Warranty claims received with insufficient information will be returned for correction and completion. Failure to send parts requested for inspection by the Technical Department within 14 days will automatically result in the request being completely rejected.

Materials returned for warranty review should be as follows:

  • The product is carefully packaged to prevent any new damage during transportation.
  • If the product is a hydraulic component, the oil must be drained and all open ports must be closed.
  • The product is shipped in a package labeled with the vehicle serial number.
  • The shipment is shipped by land as Prepaid. Item(s) returned for warranty by any other means may be rejected and returned unless prior approval is obtained with Asutay.

7) All spare parts under warranty will be sent from Asutay Technical Department, Service Department or ASSM to the buyer prepaid (land shipping only). Any other shipping method is the responsibility of the customer.

8) All warranty claims are subject to the approval of Asutay Technical department. Asutay reserves the right to limit or regulate claims regarding defective parts, workmanship or travel time.

9) In case of service requests out of warranty, travel time, service time, labor, spare part fee, accommodation, etc. The issues will be calculated under current conditions and notified to the customer by the Service Department, and necessary action will be taken after written approval and payment of the fee.

10) Whenever possible, the purchaser shall obtain all warranty support and make all warranty claims through the local Asutay authorized Distributor/ASSM. Warranty support must be from the Distributor/ASSM from which the Asutay product was purchased. In cases where Asutay product is sourced directly from the factory, if the buyer is unable to contact a Distributor/ASSM, they may contact the Asutay Service Department for further assistance.

The Buyer's rights under this Agreement are exclusive to the Buyer and cannot be transferred or transferred, unless otherwise specified by the authorized distributor/ASSM, with Asutay's prior written consent or as stipulated in a written distribution agreement between Asutay and that distributor/ASSM.

Spare Parts Warranty :

1. Any part replaced under this limited warranty is not subject to any other warranty beyond the normal warranty period of the machine on which the part is installed.

2. Any spare part sold (not delivered under a warranty) will be subject to a warranty period of six (6) months from the date of invoice.

3. Parts in stock by the Authorized Distributor/ASSM are warranted for a period of twelve months (12) from the invoice date, provided they are kept in proper storage conditions (subject to Asutay inspection) to prevent damage and deterioration.

Service Request

:Asutay Technical Department must be notified within forty-eight hours (48) in case of any potential warranty need during the applicable warranty period. Personnel performing major warranty repair or part replacement must obtain specific approval by Asutay Technical Department before performing warranty repair or replacement. When a Distributor/ASSM/Buyer believes a warranty issue exists, they should follow these steps:

  • Filling the Fault Notification Form correctly for the encountered situation and sending it to the relevant person in the Asutay Service Department.
  • Filling the Service Request Form correctly for the service need and sending it to the relevant person in the Asutay Service Department.
  • To obtain confirmation that a qualified technician is available and that this person is accepted by Asutay to perform such work within the scope of the machine's warranty so that the service can be performed by their own personnel, and to order Genuine Asutay Spare parts. Failure to do so will void the warranty.
  • Buyer / ASSM / Distributor must report the vehicle's serial number correctly. Since all warranty and repair process records will be made on the basis of the vehicle serial number, the follow-up of the process will also be made with this number.

Damages During Shipping:

  • If the vehicle is received as damaged, damage should be recorded on the bill of lading and/or delivery documents and photographs showing the current mode of transportation and condition should be taken at the delivery point before accepting the shipment.
  • The distributor/ASSM or the buyer should contact the shipping company and Asutay and a claim for damages should be registered immediately by both parties.
  • The above situation only applies to freight damage related to equipment transported by Asutay. Customer's own freight issues are excluded from this warranty policy.

Items Excluded in Addition to the Product Warranty Policy:

1. Asutay does not make any guarantees and specifically does not take any responsibility for the products that are not manufactured by him in the manufacture of the vehicle and procured from specialized OEMs (for example, electric or hydraulic motors, electronic components, hydraulic components, tires and batteries, etc.). However, Asutay requires OEMs to manufacture and supply components and parts to Asutay in accordance with all ISO, CE and/or other relevant industry standards. Asutay will not be liable under this warranty or where the defect is caused by an OEM's failure to meet this requirement. Buyer/ASSM may qualify for Original Equipment Manufacturer's (OEM) warranty, if applicable (subject to OEM terms and conditions).

2. Since the products modified or modified outside of Asutay factories and without written approval will adversely affect the stability, reliability or service life of the vehicle or any of its components, the continuation of the warranty depends entirely on the decision of the Asutay Engineering Technical Department.

3. Any Asutay product that has been exposed to misuse, improper maintenance and accident is not covered by the warranty due to user origin.

"Misuse" includes, but is not limited to, operation beyond factory specified load capacity and operating speeds.

"Improper maintenance" includes, but is not limited to, failure to follow the recommendations contained in the Asutay Maintenance and Spare Parts Manuals.

4. Normal or external wear of any Asutay vehicle component part(s). Normal wear of component parts may vary depending on the type of environment in which the machine can be used or the type of application; such as painting, sandblasting, plastering, screed work applications, but not limited to exclusion due to wear.

5. Hydraulic oil, battery fluids, engine oils, filters and lubrication/grease, paint and labels, engine tuning, brake settings, …etc. Routine maintenance items and adjustments, including but not limited to, are not covered by this warranty. Also, this warranty does not cover leaks from hoses and other ports after the vehicle has been in service for 90 days or 150 hours, whichever comes first.

6. Problems that may occur if Asutay products are in direct contact with any chemical or abrasive material are not covered by the warranty.

7. Asutay warranty policy does not cover any tax and environmental charges, including but not limited to the disposal or use of tyres, batteries and petrochemicals.

8. Failure of spare parts due to misdiagnosis or faulty assembly, etc. by the Distributor/ASSM/Buyer is not covered by the warranty.

9. Items specifically excluded are: fuel injectors, engine brushes, glow plugs, contactor tips and springs, filters, lamp bulbs, lamp lenses, coolants, hydraulic oil, battery electrolyte fluid, grease and similar lubricants and cleaning materials.

RIGHT OF OBJECTION

The Buyer may object in writing to the Asutay Service Department within 21 days of receiving the notice of rejection or correction against a claim that has been denied or corrected. The appeal must be based on clear reasons and supported by relevant evidence. Objections made outside of this period will not be considered.

This Warranty Policy expressly supersedes all other warranties, representations or obligations of Asutay, express or implied, unless otherwise amended in writing by Asutay.
